THE OFFICIAL FAWLTY TOWERS LOOKALIKE PHOTO CONTEST OFFICIAL RULES
1) CONTEST DESCRIPTION AND PERIOD: The Official Fawlty Towers Lookalike Photo Contest (the “Contest”) starts October 21, 2009 at 3:00PM Eastern Time (ET) and ends November 15, 2009 at 11:59PM ET (the “Contest Period”). The Official Fawlty Towers Lookalike Photo Contest is a contest in which participants can submit up to three (3) photo entries of their favorite character from the BBC “Fawlty Towers” television program.
2) ELIGIBILITY: CONTEST OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA 18 YEARS OF AGE OR OLDER AT THE TIME OF ENTRY. Officers, directors and employees of BBC Worldwide Americas, Inc., Facebook Inc., Marden-Kane, Inc., Wildfire Interactive and each of their respective parents, subsidiaries and affiliated companies, advertising, promotional and judging agencies, persons engaged in the development, production or distribution of materials for this Promotion (collectively, the “Promotion Parties”) and the immediate family members (parent, child, sibling, and spouse of each) of and/or persons living in the same household as such individuals (whether related or not) are not eligible to participate. This Contest is void in Puerto Rico, all US territories and possessions and where prohibited by law.
3) HOW TO ENTER: No Purchase Necessary, and no entry fee, payment or proof-of-purchase necessary to participate in the Contest. To enter, access the official BBC Fawlty towers on Facebook at http://www.facebook.com/pages/Fawlty-Towers/179053933318 and, if currently a Facebook account holder, log-in, or if not a Facebook account holder create a Facebook account. There is no fee or charge to become a registered Facebook member. After logging-in, follow the instructions to access the entry form to enter the Contest. You must complete and submit the entry form as instructed and must submit up to three (3) original photographs of yourself in which you depict a character from the BBC “Fawlty Towers” television program. To be eligible, each Photograph: (a) cannot exceed twenty (20) MB and 1600×1200 pixels in size; and (b) must be submitted in the JPG, GIF or PNG file format. Submissions not meeting these requirements may be disqualified or not fully considered, as within the sole discretion of the Sponsor. As part of the Contest entry process, entrants will be required to indicate that they have read, accept, and agree to be bound by these Official Rules. Limit: one (1) entry per person, up to three (3) photos per entry. Any individual in the sole discretion of Sponsor is suspected of registering on Facebook more than once or submits entries in excess of the disclosed maximum, by any means, including but not limited to establishing multiple e-mail accounts, will be disqualified from participation in this Contest. The name of the person submitting the Contest entry must be the authorized account holder of such email address, otherwise, entry may be deemed void. In the event of a dispute over the identity of a potential winner, the entry will be declared made by the authorized Facebook account holder and/or holder of the email address submitted at the time of entry, and potential winner may be required to provide identification sufficient to show that he/she the authorized account holder of such email address. It is the sole responsibility of the entrant to notify the Sponsor in writing if the entrant changes his or her Facebook account, e-mail, or postal address during the Contest Period.
Proof of submission of entry does not constitute proof of delivery or entry. All entries become the property of Sponsor and will not be returned to entrant. Each entry submission must be manually key stroked and manually entered by the individual entrant; automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or Contest service) will be disqualified and transmissions from these or related email or IP addresses may be blocked.
4) TERMS OF ENTRY: By submitting an entry, you warrant and represent that the photo(s): is your original work, has been legally created and has not been previously published or distributed in any media and has not been entered in or won previous contests or awards. Entry may not contain artwork not created by Entrant and must not contain material that is unlawful, in violation of or contrary to the laws or regulations where Photo was taken. Further you warrant and represent that you own all rights to your Photo, including without limitation, copyrights and that Sponsor’s publication of the Photo will not infringe on any third party rights. Only the original entrant may appear in photo(s). “Group” entries will not be accepted. Each entry must not (1) include trademarks or copyrighted material not owned by entrant or used without permission (including, but not limited to, company names, brand names, etc); (2) use individuals’ names, in whole or in part without permission; (3) refer to public figures; (4) contain profanity, pornographic, or sexual content, content promoting alcohol, illegal drugs, tobacco, firearms, or weapons, hateful content of any kind (including racism, sexism, etc.), content that promotes violence or harm to another living creature, or any other offensive, obscene, or inappropriate content; (5) defame, misrepresent, or contain disparaging remarks about other people or companies, including, but not limited to Sponsor; (6) promote a political agenda regardless of the political affiliation; (7) contain materials embodying the names or other identifying elements of any person, living or dead, without permission; (8) mention, or refer to, any competing brands of the Promotion Parties.
Sponsor and/or Administrator (as defined in Section 13 below), and/or their designated representatives, will review all entries received and will only post those entries on the contest website that conform to these Official Rules as determined by the Sponsor and/or Administrator in their sole discretion. Entries that do not comply with these Official Rules, as determined in Sponsor and/or Administrator’s sole discretion, will be disqualified from the Contest and may not appear on the contest website. Decisions of the Sponsor and/or Administrator are final and binding.
Any entry information collected from the Contest shall be used only in a manner consistent with the consent given by entrants at the time of entry, with these Official Rules, and with BBC Worldwide Americas, Inc.’s and/or Facebook’s Privacy Policy. All entries become the property of Sponsor and will not be returned to entrant.
5) PRIZES: One (1) Grand Prize will be awarded: A signed John Cleese Photo, a signed Fawlty Towers DVD, a Fawlty Towers Embroidered white terry-cloth bathrobe, a Fawlty Towers Story of Britain’s Favorite Sitcom book and a Fawlty Towers Corgi Car Toy. Approximate Retail Value (ARV) of Grand Prize: $300. One (1) Second Prize will be awarded: A signed Fawlty Towers DVD and a Fawlty Towers Corgi Car. ARV of Second Prize: $80. One (1) Third Prize will be awarded: A signed Fawlty Towers DVD. ARV of Third Prize: $50. Total ARV of all prizes: $430. Limit one prize (1) per person. No more than the listed number of prizes will be awarded. All taxes and any other costs related to the prize not specifically stated within these Official Rules are the sole responsibility of the winner. Prizes will be awarded by U.S. mail and/or e-mail. No substitution, cash redemption, assignment, of prize permitted. However, Sponsor reserves the right to substitute a prize or portion of a prize with one of equal value in the event prize is unavailable.
6) WINNER SELECTION:
Public Voting to Select the Finalists: All entries meeting the minimum eligibility requirements will be posted to the official BBC Fawlty Towers promotion page located on Facebook and visitors will have the opportunity to vote for the Finalists. The Voting Period will be held between 12:01 a.m. ET on November 16, 2009 – 11:59 p.m. ET on November 22, 2009. The ten (10) entries obtaining the most “thumbs up” votes will be deemed the Finalists. Limit one (1) vote per person. Subsequent votes in excess of stated limit by a single Registered User will be disqualified.
Winner Selection: On or about 11/25/09, the ten (10) Finalists will be judged by Mr. John Cleese who will score each submission based on the following judging criteria: A) Quality of costume B) Accuracy of likeness C) Personal preference each of which will be weighted equally (33.33% each). Mr. Cleese will choose the highest scoring entries which will be deemed the Grand, Second and Third Prize Winners, respectfully.
In the event of a tie for determining the Finalists or Winners, all tied entries will be re-judged by an additional “tie-breaking” judge selected by Sponsor who will use the Judging Criteria above to break the tie. The Sponsor’s decisions are final and binding in all matters relating to this Contest.
All prizes will be awarded provided a sufficient number of qualified eligible entries are received. Non-winning and/or ineligible entrants will not be contacted
7) WINNER NOTIFICATION AND PRIZE FULFILLMENT: Potential winners will be notified by email and or postal mail at the postal address provided within five (5) business days of the close of winner selection. Any winner notification returned as undeliverable without a forwarding address will result in prize forfeiture and an alternate winner may be selected at Sponsor’s discretion. Potential winners may be required to sign and return to Sponsor an Affidavit of Eligibility/Liability Release with (where lawful) a publicity release for receipt by Sponsor by the due date indicated in the notification letter. If any required documents are not returned within the required number of days, or if any mail is returned as undeliverable without forwarding address, then prize may be forfeited and an alternate winner may be selected at Sponsor’s discretion. If a potential prize winner is an eligible minor in their state of residence, the applicable prize may be awarded to his or her parent or legal guardian, who will be required to sign and return all prize acceptance documents and assume all responsibilities of the prize winner.
8) CONDUCT: This Contest is subject to the laws of the United States only. By entering this Contest, entrants agree to be bound by these Official Rules and the decisions of the Sponsor that shall be final and binding in all respects. These Official Rules are accessible from http://www.bbcamericashop.com/fawlty-towers-photo-contest.html throughout the Contest Period. Failure to comply with these Official Rules may result in disqualification. Entries must not have previously won any contest or award and the right to use the entry by the Promotion Parties must not be restricted in any way. Entry submissions cannot defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights. Modifying, enhancing or altering a third party’s pre-existing work does not qualify as Entrant’s original creation. If the entry submitted includes likenesses of third parties or contains elements not owned by the Entrant, Entrant must be able to provide legal releases (“Releases”) for such use including Sponsor’s use of such entry, in a form satisfactory to the Promotion Parties. Promotion Parties are not responsible for typographical errors or any other errors in entries submitted. By submitting an Entry, each Entrant represents and warrants that it is wholly original with her/him, she/he owns all right, title and interest in and to the Entry, that she/he has committed no fraud or deception in connection with such Entry, and that she/he has the sole and exclusive right to grant, transfer and assign all rights in and to such entry to the Promotion Parties. Promotion Parties assume no responsibility for any third party use of any photo posted to the website.
Sponsor reserves the right at its sole discretion to disqualify any individual suspected of tampering with the entry process or the operation of the Contest; or to be acting in any manner deemed by Sponsor to be in violation of the Official Rules; or to be acting in any manner deemed by Sponsor to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND COSTS (INCLUDING WITHOUT LIMIATION, ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
9) LIMITATIONS OF LIABILITY: Promotion Parties assume no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Contest; © any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Contest; (d) inaccessibility or unavailability of the Internet or any combination thereof, or; (e) any injury or damage to participant’s or to any other person’s computer which may be related to or resulting from any attempt to participate in the Contest or download any materials in the Contest. If, for any reason, the Contest is not capable of running as planned for reasons which may include without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest in whole or in part.
10) WINNER RELEASES: All entrants, as a condition of entry into the Contest, agree to release BBC Worldwide Americas, Inc., Facebook Inc., Marden-Kane, Inc., Wildfire Interactive and each of their respective parents, subsidiaries and affiliated companies, suppliers, printers, application developers, advertising, promotional or judging agencies, from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with accessing the Contest page; submitting an entry or otherwise participating in any aspect of the Contest; the receipt, ownership or use of any prize awarded; preparing for, participating in or traveling to and/or from any prize-related activity, or any typographical or other error in these Official Rules or the announcement of offering of any prize. The winners shall bear all risk of loss or damage to their prize after it has been delivered. Sponsor makes no representations or warranties of any kind concerning the appearance, safety, or performance of any prize. Except for residents of Tennessee and where prohibited by law, winners grant to Sponsor the right to print, publish, broadcast and use worldwide in any media now known or hereinafter known (including without limitation use online at the Web Site) the winner’s entry, name, address, voice, statement, picture or other likeness, without additional compensation, for public relations, advertising and promotional purposes as may be determined by Sponsor.
11) ADDITIONAL CONTEST TERMS: By entering this Contest, and to the extent allowed by law, entrants grant the Promotion Parties and each of their affiliates, licensees, promotional partners, and third party marketing entities the absolute right and permission to edit, modify, cut, rearrange, add to, delete from, copy, reproduce, translate, dub, adapt, publish, exploit, and use the content of and elements embodied in the entries, in perpetuity in any and all media, including but not limited to digital and electronic media, computer, audio and audiovisual media (whether now existing or hereafter devised), in any language, throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation.
12) WINNERS LIST: To request the names of the winners, available after December 15, 2009, send an e-mail with subject line: “Fawlty Towers Sweepstakes Winners” to winnerslist@mardenkane.com. Requests must be received by January 15, 2010.
